This Act is the Employment Relations Amendment Act (No 3) . This Act comes into force 6 months after the date on which it receives the Royal assent. This Act amends the Employment Relations Act 2000. Section 5 is amended by inserting the following definition in its appropriate alphabetical order: means a person— who has a contract or other arrangement with an employer under which an employee of the employer performs work for the benefit of the person; and who exercises or is entitled to exercise control over the employee that is substantially similar to the control an employer exercises or is entitled to exercise in relation to the employee The principal Act is amended by inserting the following section after section 65: This section applies where— an employee is a member of a union, but t
