This Act is the Commerce (Criminalisation of Cartels) Amendment Act . This Act comes into force on the second anniversary of the date of Royal assent. This Act amends the Commerce Act 1986 (the ). inserted After section 82A, insert: A person commits an offence if— the person,— in contravention of , enters into a contract or arrangement, or arrives at an understanding, that contains a cartel provision; and intends, at that time, to engage in price fixing, restricting output, or market allocating; or the person,— in contravention of , gives effect to a cartel provision; and intends, at the time the cartel provision is given effect to, to engage in price fixing, restricting output, or market allocating.
